1. General

1.1.    This website/Company is operated by JustDeliver ("we", "us" or "our"). By using the JustDeliver.co.uk  website you are bound by these Terms & Conditions. All purchases made on this website are governed by the Terms & Conditions at all times. If you use or order goods after we have published any changes you will be bound by those changes. It is essential that you check prior to each use or order to ensure that you understand the precise Terms & Conditions when purchases are made. The Terms & Conditions will be consistently updated  in order to assist you with information regarding changes made since your most recent order. We will be working in partnership with Korkmaz Food Centre, located at 363-365 Holloway Road, N7 0RN. We will offer you a smooth and exceptional service to ensure that you (Customers/Users) get the best out of JustDeliver.co.uk. 

1.2.    JustDeliver is a sole and separate company. It is an acting agent for Korkmaz Food Centre, which delivers and displays Korkmaz Food Centre's goods on the web site.

1.3.    Order confirmation will be given straight after the payment goes through. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the email address you have provided to us. At the point where you order from us that is the offer, a  contract is formed when we dispatch the order with the intention to purchase, where acceptance will take place. We will supply the goods to you in accordance with your order using these Terms and Conditions as guidance.

1.4.    In order to use the service you must have completed the registration process and must be 18 years or over.

1.5.    The law places certain restrictions on transactions involving alcohol, and accordingly alcohol must be delivered by us during normal licensing hours. If you have ordered alcohol from us and cannot be at home at your selected delivery time, it is your responsibility to ensure that a suitable person is there to receive the order. We operate a “Challenge 25” policy, which means that if the person receiving delivery of alcohol looks under 25, our drivers will request some form of ID. If the person receiving the alcoholic drink is unable to produce appropriate ID, our driver will be unable to leave the alcoholic drinks or any age restricted items. We may also request identification in relation to other age restricted products such as knives and tobacco.

1.6.    Once the alcoholic drink, tobacco or any other age restricted products have been delivered with proof of ID, it becomes the recipient's responsibility of its use.

2. Price & Quantity

2.1.    Actual price you pay will be different/same as the price charged in store at the time your order is picked for delivery. The price of perishable items may vary from store prices. The actual order value cannot be determined because the prices stated on the website may vary either above or below the prices in store on at the time 'Checkout' is performed.We reserve right to change prices on the web site at any time.

2.2.    Where items are ordered and sold individually by weight (such as certain fresh meat, poultry, fish, cheese, bakery or fruit and vegetables), the price of these items (expressed per kilogram or other appropriate unit of measurement) will be the price on the day of dispatch by us. Most 'Weighable' goods will be pre - packed, meaning it will be available in certain sizes. Please note that some measurements may be above or below the weight given. There may be a minimal 1% increase or decrease in weight.

2.3.    We may limit the quantities of goods (particularly goods on special offer & large space consuming goods) supplied to any one customer if in our opinion the quantity ordered jeopardises availability for other customers. In the event of non-availability of any goods you order, we may offer a reasonable substitute. This may affect the price you pay. You may reject any substitute item and we will refund the amount you have been charged for that substitute. It is our policy to identify any substitute items to you at the time of delivery and give you the opportunity to accept or reject the item at that time.

3. Delivery

3.1.    Delivery days will be specified on the delivery booking page on the website (including Sunday) and will be made to the address you have given us when you register on the website. You have the ability to change this address through the "Address Book" feature on 'My Account', and you must do so if you move home so that we can deliver to the correct address. We reserve the right to restrict deliveries in certain areas, and this includes the right to eliminate certain areas from our delivery schedule altogether.

3.2.    There is a minimum order requirement of £40 (excluding delivery charges) for every order placed. Cigarettes, Cigars, Tobacco will not contribute to the minimum spend.

3.3.    Please note adverse weather conditions or other events outside of our reasonable control may result in the occasional late or cancelled delivery. If that is the case we will endeavour to contact you as soon as we are able to reschedule your delivery date.

4. Payment Types

4.1.    Payment may be made by debit, credit and some business account cards, as well as Maestro and MasterCard. You cannot pay for your order by cash or cheque.

4.2.    We do not store or keep your card details.

4.3.    Any card information is transmitted via Barclaycard Secure.

5. Defective Goods

5.1.    We guarantee the quality of our goods. You must inspect the goods and notify us promptly by phoning or email if you have any dissatisfaction with your order. We will promptly and fully refund the price of any goods or replacement of goods that do not meet with your reasonable satisfaction, provided that you notify us within 14 days of delivery of the goods. We will arrange with you for the goods to be returned to us.

6. Order Amendments & Cancelation Rights

6.1.    The confirmation e-mail you receive from us confirming your order will set out the last time that you   may amend your order prior to delivery.

6.2.    In respect of non-perishable items, you have the right to cancel the contract at any time until the expiry of the 14th working day after the date of delivery of the goods by notifying us by telephone or e-mail. We ask that items are returned in to us with their original packaging and with any tags intact. In the case of items which include a hygiene or security seal, we ask that you exercise reasonable care by not removing the seals while examining the goods, unless you are certain that you intend to keep the goods. In the event that any seals or tags are removed or tampered with, we shall not permit that item to be returned nor shall we refund the cost of this item to you.

6.3.    In the case of perishable items you do not have the right to cancel the contract. Should you wish to cancel your order after the cut off period but prior to the time of delivery, we shall be entitled to charge you in full for an amount equal to the price of the perishable items contained in your order.

6.4.    We will arrange with you for cancelled non-perishable goods to be returned to us, and we will credit your payment card with the price of such goods within 30 days from the date you returned the goods to us (provided payment has already been debited to your payment card).

7. Privacy

7.1.    We respect your privacy. The personal information that you give us is held with care and security. We do not sell, rent or transfer this information to third parties for their marketing purposes. We will not share your information with other businesses apart from Korkmaz Food Centre, whom we work with.

7.2.    At the time of your registration you will choose a password. Please keep this secret, as you are entirely responsible if you do not maintain the confidentiality of your password. You are entirely responsible for all orders placed with us or information given to us under your e-mail address in combination with your password. You must immediately notify us of any unauthorised use of your e-mail address and/or password or any breach of security known to you.

8. Customer Complaints

8.1.    Any Customer complaints should be addressed to the JustDeliver Customer Services. You will find an e-mail and telephone numbers listed on the 'Contact Us' section.

9. Offers/Promotions

9.1.    From time to time, goods may be subject to special offers. In the event that such a special offer applies to your purchase, the terms of special offers shall be subject to these Terms & Conditions. If there is any conflict between the terms of a special, these Terms & Conditions shall prevail unless specifically excluded.

9.2.    Goods that are on special offer may hold quantity restrictions, as we strive to make sure every customer benefits from them.

9.3.    Please make sure you check on which item(s) apply to the offer. When there is a 'mix & match' offer, some items may be excluded, whether or not the item has the same brand or whether it is a different variety to those on offer.

10. Warranty/Liability

10.1.   None of these Terms and Conditions will restrict our liability for death or personal injury resulting from our Negligence, Breach of Statutory Duty and Breach of Contract, nor will any of these terms restrict any of your statutory rights.

10.2.   We will not be deemed to be in breach of contract or of these Terms & Conditions as a result of any:

  • · Delay in our performance.
  • · Failure to perform our obligations due to that delay.
  • · Failure to perform is due to the belief to any cause or circumstance that is beyond our reasonable control including ( but not limited to);
  • · Fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.

11. Cancellation Clauses

11.1.  We reserve the right to cancel your delivery at any time if we suspect; fraud, have reason to believe you are in breach of these Terms and Conditions or any other terms and conditions relating to your order, outstanding payment for any account registered at your address. If you are in breach of our terms and conditions relating to Discount Offers , we may cancel your order. In the event that we cancel your order, you will receive email notification and you will be able to contact our customer services.

11.2.  We reserve the right to suspend your account. Your account will remain suspended until you contact us in order enable our team to reactivate your account. You must give reasonable information for this.

11.3.  In events where there are unforeseen operational or technical issues that occur, we may need to cancel or rearrange the delivery. If this happens we will contact you to arrange an alternative delivery day.

12. Click & Collect

12.1.   If you chose to collect your order from the store, the time slot will be agreed with you when you place your order. Same day Click & Collect may be available.

12.2.  All Click & Collect orders will be collected from Korkmaz Food Centre, Located at 363-365 Holloway Road, N7 0RN.

12.3.   You Must Bring your ID.

12.4.   Your order number and credit card used to order on the web site will be required.

12.5.  There will be a £40 minimum spend on Click & Collect.
